The Fair Housing Act

The Fair Housing Act, Title VIII of the Civil Rights Act of 1968, prohibits discrimination in the sale, rental, and financing of dwellings based on:

Prohibited Practices

Under the Fair Housing Act, the following practices are prohibited:

  • Refusing to sell or rent a dwelling after a bona fide offer has been made
  • Discriminating in the terms, conditions, or privileges of sale or rental
  • Making, printing, or publishing any statement that indicates a preference, limitation, or discrimination
  • Representing that a dwelling is not available when it is available
  • Denying access to or membership in any multiple listing service or real estate brokers' organization
  • Blockbusting or steering
  • Discriminating in the provision of brokerage services
  • Coercing, intimidating, threatening, or interfering with anyone exercising their fair housing rights
